Terms of Service
The rules for using Gully Pay on the web and in the apps, as a customer paying with your wallet or as a business taking payments.
This draft describes how Gully Pay works today, based on what the product actually does. Our lawyers have not reviewed it yet, and the reviewed version may change the wording. Questions: [email protected].
The agreement
These terms are an agreement between you and Gully Labs for the use of Gully Pay: the website gullypay.xyz, its API and SDKs, and the Gully Pay and Gully Pay Merchant apps. By creating an account or using the service you accept them. If you use Gully Pay for a business, you accept them for that business and confirm you may do so.
You must be at least 18 and able to enter a binding contract to use Gully Pay.
What Gully Pay does
- Hosted checkout and payment links that accept cards (through Stripe) and stablecoins on supported networks.
- An x402 facilitator that lets APIs charge per request, and a merchant dashboard for payments, orders, products and payouts.
- A custodial stablecoin wallet for sending, receiving and paying merchants.
- Support for Gully Chain. Gully Chain Testnet is labelled as a testnet wherever it appears; testnet tokens have no monetary value.
Your account
- Give accurate information and keep it up to date. We may ask you or your business to verify your identity.
- Keep your password, two-factor codes, passkeys and API keys secret. You are responsible for activity under your account.
- Tell us at once at [email protected] if you think your account has been compromised.
The custodial wallet
- We create your wallet and hold its private key, encrypted, on your behalf. You instruct transfers through the app or the website.
- Blockchain transfers cannot be reversed. Check the address and network before you send. Funds sent to a wrong address or network may be lost.
- Network fees may apply to transfers. Balances shown are read from the blockchain and can briefly lag behind it.
- We may pause or refuse a transfer when the law requires it, to protect you or others from fraud, or while we investigate a security issue.
- Gully Pay is not available in every country. We may limit or end availability where we are not permitted to offer it.
Gully Pay is a payments service. Nothing in it is investment, legal or tax advice, and stablecoin balances earn no interest.
Selling with Gully Pay
- Your business may need to pass a verification review before it can take live payments or receive payouts.
- You are responsible for what you sell, for your prices, taxes, delivery, refunds and customer service, and for following the law where you sell.
- Payouts are sent to the destination you set. Stablecoin balances owed to you are paid out on-chain from the platform wallet.
- You are responsible for refunds and for responding to disputes and chargebacks on your payments. Card networks and Stripe may reverse card payments under their rules.
- Keep your API keys and webhook secrets safe, and verify webhook signatures before acting on them.
Fees
Fees are listed on the pricing page and are deducted from each payment or settlement. We will give you notice before fees for your account go up.
What you must not do
- Use Gully Pay for anything illegal, including fraud, money laundering, terrorist financing or sanctions evasion.
- Sell prohibited goods or services, or process payments for another business without our agreement.
- Attack, overload, probe or reverse-engineer the service, or get around rate limits or security controls.
- Use another person's account, card or wallet without permission.
Other services
Card payments are processed by Stripe, and stablecoin payments run on public blockchains that we do not control. Their availability, fees and rules are outside our control, and their terms may also apply to you.
Closing your account
You can close your account at any time: in the app (Settings, Sessions and account, Delete account) or at gullypay.xyz/account/delete. So that no money is ever left behind, closing is paused while your wallet still holds funds, a payout is in progress, or a business you solely own is still owed money or has open checkouts or disputes. The page tells you what to do first.
We may suspend or close an account that breaks these terms or when the law requires it. We will tell you why where we are allowed to, and help you withdraw funds that are lawfully yours. What we keep after closing is described in the privacy policy.
Disclaimers and liability
We work to keep Gully Pay available and secure, but it is provided as is and may sometimes be interrupted. To the extent the law allows, we are not liable for indirect or consequential losses, or for losses caused by blockchains, card networks or other services we do not control, or by transfers you instructed.
Nothing in these terms limits liability that cannot be limited by law.
Changes and governing law
We will update the date at the top when these terms change and tell you before a material change takes effect. The governing law and the courts that hear disputes will be named here once the legal review of this draft is complete.
